Terms of Service

1. Provider and scope

These Terms are between you and TUCKR89 LLC ("TuckR89," "we," "us," or "our") and apply to TuckR89 mobile apps, apps.tuckr89.com, and related services unless a separate agreement expressly applies.

2. Eligibility and accounts

You must be legally capable of entering into these Terms. Some apps do not require an account. Madison Paycheck and TuckR89 Cloud may provide account-based features. You are responsible for accurate account information, maintaining the security of credentials and devices, and activity performed through your account. Notify us promptly if you believe an account has been compromised.

3. License and acceptable use

Subject to these Terms and applicable store rules, TuckR89 grants you a limited, non-exclusive, non-transferable, revocable license to use the apps for their intended personal or business purposes. You may not misuse the services, interfere with security or operation, attempt unauthorized access, use the services to distribute malware or unlawful content, circumvent purchase or access controls, or use the services in violation of law or another person's rights.

4. User content and cloud files

You retain ownership of content you enter, create, attach, export, or upload. You grant TuckR89 a limited license to host, copy, transmit, process, and display that content only as reasonably necessary to operate, secure, support, and improve the service you requested. You represent that you have the rights necessary to use and upload your content. You are responsible for maintaining appropriate copies of important data and for content you choose to export or share with third parties.

5. Subscriptions and purchases

Paid features may be sold through Google Play or Apple. Prices, billing periods, trials, renewals, taxes, cancellation, refunds, and payment processing are governed by the offer shown at purchase and the applicable store's rules. Subscriptions generally renew automatically unless canceled through the store account before renewal. Deleting an app or account does not automatically cancel an app-store subscription; manage subscriptions through Google Play or Apple as applicable.

6. Estimates and informational tools

Truck Profit, Truck Fuel Surcharge Pro, Truck Maintenance, and Madison Paycheck provide calculations, projections, reminders, records, or planning information. Outputs depend on user inputs, assumptions, rates, tax rules, device state, and other variables and may not reflect actual results.

Madison Paycheck is an estimation tool, not a payroll processor, tax preparer, accountant, attorney, or financial adviser. Paycheck and tax estimates are for informational planning purposes and are not tax, legal, payroll, accounting, or financial advice. Verify important payroll, withholding, tax, business, maintenance, safety, and financial decisions using authoritative records and qualified professionals where appropriate.

7. Trucking and maintenance safety

Truck-related apps are recordkeeping and planning tools and are not a substitute for inspections, manufacturer instructions, regulatory requirements, professional mechanical judgment, dispatch or carrier requirements, or safe operating practices. Do not rely on an app reminder as the sole means of determining whether a vehicle is safe or legally compliant.

8. Reminders and notifications

Notifications in Due & Done, NudgeBack, Truck Maintenance, or other apps are convenience features. Delivery can be affected by device settings, battery optimization, permissions, operating-system behavior, time-zone changes, or other conditions. You remain responsible for deadlines, maintenance, payments, renewals, appointments, and other obligations.

9. TuckR89 Cloud

TuckR89 Cloud provides hosted file storage and account services subject to available storage limits, technical restrictions, and plan features. You must not store or distribute unlawful content or use the service to infringe rights, compromise systems, or facilitate abuse. We may apply reasonable technical limits to protect service reliability and security. Service-specific legal terms displayed at tuckr89cloud.app also apply to TuckR89 Cloud and control for service-specific matters if they conflict with these general Terms.

10. Availability and changes

We may add, change, suspend, or discontinue features, content, integrations, or services. We do not guarantee uninterrupted or error-free availability. Features marked "coming soon," beta, preview, or similar may change or may not be released.

11. Third-party services

Apps may interact with Google Play, Apple services, Firebase/Google services, hosting providers, device operating systems, or user-selected sharing/storage destinations. Those third parties operate under their own terms and policies. TuckR89 is not responsible for third-party products or services outside our control.

12. Intellectual property

The apps, websites, software, branding, designs, and TuckR89-provided content are owned by TuckR89 or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of TuckR89 intellectual property to you.

13. Account suspension and termination

You may stop using the services at any time. Where account deletion is supported, follow the in-app controls or Data & Account Deletion page. We may restrict or terminate access when reasonably necessary to address material violations of these Terms, unlawful activity, fraud, security threats, abuse, nonpayment, or risks to users or the service. Where practicable and appropriate, we will provide notice.

14. Disclaimers

To the maximum extent permitted by law, the apps and services are provided "as is" and "as available." TuckR89 disclaims warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by law, TuckR89 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, business opportunities, goodwill, or data arising from use of the apps or services. Where liability cannot be excluded, it will be limited only to the extent permitted by applicable law. These limitations do not apply where prohibited by law.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold TuckR89 harmless from third-party claims arising from your unlawful use of the services, your infringement of another person's rights, or content you upload or distribute through the services. This section does not apply where prohibited by applicable law.

17. App-store terms

Your use of an app downloaded through Google Play or the Apple App Store is also subject to the applicable store terms. Apple and Google are not responsible for TuckR89's support obligations except as required by their own terms or applicable law. If store terms provide you additional mandatory rights, those rights are not limited by these Terms.

18. Governing law

These Terms are governed by the laws applicable to TUCKR89 LLC in the United States, without regard to conflict-of-law principles, except to the extent consumer-protection or other mandatory law in your jurisdiction requires otherwise. Nothing here limits rights that cannot be waived under applicable law.

19. Changes to these Terms

We may update these Terms to reflect changes in products, services, law, security, or business practices. We will update the date above and provide additional notice when appropriate. Continued use after revised Terms become effective constitutes acceptance where permitted by law.
